Agreement to Terms

By accessing or using https://www.beverlyfarm.org/ (the “Site”), you agree to these Terms of Service. If you do not agree to these Terms, please do not use the Site.

About Beverly Farm Foundation and the Site

Beverly Farm Foundation is a nonprofit organization that provides residential care and meaningful opportunities for adults with intellectual and developmental disabilities. The Site provides information about our programs and services, facilitates donations and Equestrian Center registrations, connects volunteers with opportunities, and helps families and community members stay connected with life at Beverly Farm.

Informational Nature of the Site

Content on the Site is provided for general informational purposes. Information on the Site is not intended to constitute medical, legal, clinical, financial, or other professional advice and should not be relied upon as a substitute for advice from an appropriately qualified professional. Use of the Site, submission of an inquiry, or receipt of information through the Site does not by itself establish a resident, client, patient, provider, or other professional relationship with Beverly Farm Foundation.

User Accounts and Information You Submit

We do not generally require user accounts to access the Site. Certain features may ask you to provide personal information. Information submitted through the Site is handled in accordance with our Privacy Policy. Please do not submit sensitive medical, health, financial, or other confidential information through a general website form unless the form specifically requests that information.

Payments, Donations, Billing, and Refunds

Equestrian Center registrations, including riding camps and Barn Buddies programs, are processed through PayPal. Online donations to Beverly Farm Foundation are processed through Qgiv. Payments and donations may therefore also be subject to the applicable third-party processor’s terms and privacy practices.

Donations are generally non-refundable, except as required by law or when Beverly Farm Foundation determines that a refund is appropriate, such as in the case of a processing error or duplicate transaction.

Equestrian Center registration fees are non-refundable except in the following circumstances:

Beverly Farm Foundation cancels the program or session due to weather, staffing, or other operational reasons, in which case a full refund or credit toward a future session will be provided.
A registrant is unable to attend due to a documented medical reason, in which case Beverly Farm Foundation will consider a refund or credit request on a case-by-case basis.
A registration was made in error, such as an accidental duplicate purchase or unintended registration, in which case Beverly Farm Foundation will consider a prompt refund request on a case-by-case basis.

Acceptable Use

You agree not to use the Site for any unlawful purpose; attempt to gain unauthorized access to the Site or its systems; introduce malicious code; interfere with the security, availability, or operation of the Site; impersonate another person or entity; or use the Site in a manner that infringes the rights of Beverly Farm Foundation or others.

Intellectual Property

Unless otherwise indicated, content on the Site, including text, graphics, logos, photographs, videos, and other materials, is owned by Beverly Farm Foundation or used with permission and is protected by applicable intellectual property laws. You may use Site content for personal, noncommercial purposes, but may not reproduce, distribute, modify, or commercially exploit it without permission except as permitted by law.

Third-Party Services and Links

The Site may link to or use services provided by third parties, including payment processors, fundraising platforms, analytics providers, social media services, and other external resources. Beverly Farm Foundation does not control third-party sites or services and is not responsible for their content, availability, security, privacy practices, or terms. Your use of third-party services is subject to their applicable terms and policies.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and its content are provided on an “as is” and “as available” basis. Beverly Farm Foundation does not warrant that the Site will be uninterrupted, error-free, secure, or free from harmful components, or that information on the Site will always be complete, current, or accurate.

Limitation of Liability

To the fullest extent permitted by applicable law, Beverly Farm Foundation and its directors, officers, employees, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of, or inability to use, the Site. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Beverly Farm Foundation and its directors, officers, employees, agents, and affiliates from claims, liabilities, losses, damages, and reasonable expenses arising from your unlawful or unauthorized use of the Site or your material violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute relating to the Site or these Terms will be handled in a court of competent jurisdiction in Illinois, subject to applicable law.

Changes to These Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
